When the wheels came off at home Nick was really shocked.
Things weren’t good at home and the rows and the cold shoulder from his wife were really getting him down. But when the breakup finally came to a head he realised that he was being asked to give up everything he had worked hard for – the house, his pension and even part of his business.
Nick had been so busy at work that he realised he had just let things drift. Being sent a divorce petition by his wife’s solicitor made him realise he needed advice. He came to Family First Solicitors looking for divorce advice in Winnersh Reading, for a £60 first appointment we advised him that things were not as bad as he thought.
His business was not going to be considered to have a value, really it was an income generating asset that only he could manage and his wife would need to give back her shares in the business for nothing.
We helped Nick see that he had choices about what he could offer his wife to come to a fair settlement. Maybe he could swap his pension for some of the house, or perhaps the house could stay in joint names until the kids grow up but then be split 50/50. If possible, Nick wanted to limit the amount of spousal maintenance he paid his wife, and we helped him keep it down to 3 years and then a complete clean break.
Nick was able to settle his divorce without going to court, just using Family First to conduct the negotiation. We knew that if it didn’t settle quickly then it needed to go to court. Neither Nick nor Family First are interested in endless letter writing. Fortunately, Nick’s ex wanted a fast settlement too as she had met a new partner. Both parties moved on, and both parties feel fairly treated.
